Deadlines for Meeting Your Pay Equity Obligations


Compliance Calendar: DEMES, Exercise, Maintenance and Program

Under Québec’s Pay Equity Act, covered employers must comply with strict deadlines for DEMES, pay equity exercises, programs, and five-year maintenance. Missed deadlines can lead to penalties and legal exposure. This compliance calendar helps you stay on track and avoid unnecessary risk.


DEMES - Employer's pay equity declaration

For businesses registered with the Enterprise Register, the declaration must be filed within six (6) months following the end of their fiscal year. It is therefore essential to accurately identify the fiscal year-end date to avoid any delay or omission.


As for employers listed in the register of public enterprises, as well as organizations under the authority of the Treasury Board, the declaration must be submitted no later than September 1 of each year, regardless of their fiscal year-end date.


Pay Equity Exercise

The applicable deadline depends on the date the business commenced operations as well as on the reference period during which it reaches an average of 10 employees or more per year. Once this threshold is reached, the employer has a maximum period of four (4) years to complete its initial pay equity exercise, in accordance with the applicable legal requirements.


Pay Equity Program

The deadline depends on the start of the company's activities and the reference period during which it reaches 10 or more employees. Once this threshold is reached, the employer has a maximum period of four (4) years to complete its pay equity program, in accordance with the applicable legal requirements.


Pay Equity Audit or Maintenance

Pay equity maintenance must be carried out every five (5) years following the date on which the employer completed its initial pay equity exercise, its pay equity program, or its previous pay equity maintenance.
