DEMES: Employer’s Declaration Regarding Pay Equity


Who is Required to File the DEMES Statement Annually?

The Employer's Declaration Regarding Pay Equity (DEMES) is intended to demonstrate the level of progress achieved in pay equity within your organization and to confirm compliance with the legal obligations set out under the Pay Equity Act. The DEMES must be filed annually, regardless of whether a pay equity exercise, pay equity plan or program, or a pay equity maintenance evaluation has been completed. It is a separate and essential legal requirement to ensure ongoing employer compliance.


Since the adoption of the regulation that came into force on March 1, 2011, the filing of the DEMES has been mandatory for:


  • All businesses registered with the Québec Enterprise Register (REQ) that have declared a minimum of six (6) paid employees.
  • All employers registered in the public authorities file, regardless of organizational size.
  • The Treasury Board.
